Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the FoodLens mobile application ("App"), you ("User") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. These Terms form a legally binding agreement between you and MJAndroid Dev ("Developer", "we", "us", "our").

If you do not agree to these Terms, you must immediately uninstall and cease using the App.

2. Description of the App

FoodLens is an Android application that enables users to:

• Photograph food labels and extract ingredient text via on-device OCR
• Scan barcodes to retrieve product information from the Open Food Facts public database (Pro feature)
• Analyse ingredients against a local database of over 6,000 ingredients and food additives
• Check compatibility with dietary preferences (Vegan, Vegetarian, Jain, Gluten-Free)
• Detect potential allergens based on a user-configured allergen profile
• Receive personalised cautions based on health conditions (Diabetes, Hypertension, Pregnancy, High Cholesterol, Kidney Caution)
• Export PDF health reports (Pro feature)
• Search ingredients via an in-app WebView
• Maintain a local history of scanned products

3. Medical Disclaimer

Specifically:

• FoodLens does not provide medical diagnoses or treatment recommendations.
• Ingredient safety ratings and health cautions are based on general publicly available information and may not account for individual health circumstances.
• Users with food allergies, intolerances, or serious health conditions must consult a qualified healthcare professional before making dietary decisions.
• The App's allergen detection is a supplementary aid only — always read original product labels and consult manufacturers for authoritative allergen information.
• FoodLens does not guarantee that its ingredient database is exhaustive or completely up to date. Food formulations change; always check current product packaging.
• For life-threatening allergies, do not rely solely on FoodLens. Read the product label directly or consult the manufacturer.

The Developer expressly disclaims all liability for any harm, loss, injury, or adverse health event arising from reliance on information provided by the App.

4. Eligibility

You must be at least 13 years of age to use FoodLens. By using the App, you represent that you are at least 13 years old. If you are under 18, you confirm that you have obtained parental or guardian consent to use the App.

Users under 13 are not permitted to use the App. If we become aware that a user under 13 has created a profile or used the App, we will take appropriate steps to address this.

5. License to Use

Subject to your compliance with these Terms, the Developer grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Android devices you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, or sublicense the App or any part of it
• Reverse-engineer, decompile, or disassemble the App (except where permitted by applicable law)
• Remove or alter any proprietary notices in the App
• Use the App for commercial purposes without our express written permission
• Use the App in any way that violates applicable laws

6. Prohibited Uses

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights
• Attempt to extract, scrape, or harvest data from the App's local database for commercial use
• Interfere with or disrupt the App's functionality or any third-party services it connects to
• Misuse the Open Food Facts API beyond personal, non-commercial use as facilitated by the App
• Circumvent or disable Pro subscription restrictions through technical means

7. Subscription & In-App Purchases

7.1 Plans

FoodLens offers the following paid plans ("Pro"):

• Monthly Pro: auto-renewing monthly subscription (₹149/month or equivalent in local currency)
• Yearly Pro: auto-renewing annual subscription (₹799/year or equivalent)
• Lifetime Pro: one-time purchase (₹1,499 or equivalent)

Prices are set in Indian Rupees and may vary by country based on Google Play's local pricing. All amounts shown are inclusive of applicable taxes where required.

7.2 Billing

All purchases are processed by Google Play Billing. By completing a purchase, you agree to Google Play's payment terms. Subscriptions are automatically renewed at the end of each billing period unless cancelled at least 24 hours before the renewal date.

7.3 Pro Features

Pro subscribers receive:

• Unlimited daily scans (vs. 5/day for free users)
• Barcode scanning via Open Food Facts
• PDF health report export
• Unlimited scan history (vs. 10 items for free users)
• No advertisements

7.4 Cancellation

You may cancel a subscription at any time via:

• Google Play app → Profile → Payments & subscriptions → Subscriptions → FoodLens
• Or: play.google.com/store/account/subscriptions

Cancellation takes effect at the end of the current billing period. You retain Pro access until that date.

8. Refunds

All purchases are subject to Google Play's refund policy:

• For apps purchased on Google Play, users may be eligible for a refund within 2 hours of purchase via the Play Store
• For subscriptions, refund eligibility is determined by Google Play on a case-by-case basis
• We are unable to process refunds directly; all refund requests must be submitted to Google Play

9. Advertisements

The free tier of FoodLens is supported by advertising via Google AdMob. By using the free tier, you agree to the display of banner and interstitial advertisements. Ads are delivered by Google and are subject to Google's advertising policies.

We do not control the content of advertisements. If you encounter an advertisement that you believe is inappropriate, please report it to Google via the AdMob feedback mechanism.

Pro subscribers are completely ad-free.

10. Data Accuracy & Limitations

FoodLens uses a curated local database of ingredients and food additives. While we strive for accuracy, we make the following important disclosures:

• Database completeness: The database may not contain every ingredient or additive used in every product. Unlisted ingredients will show as "unknown" rather than safe.
• OCR accuracy: On-device text recognition may produce errors, especially with small print, unusual fonts, or damaged labels. Always cross-reference with the original product label.
• Barcode data: Product information from Open Food Facts is crowd-sourced and may be incomplete, outdated, or inaccurate for some products.
• Additive safety levels: Safety classifications are based on widely accepted public health data and regulatory standards. Individual sensitivities may differ.
• Formulation changes: Food manufacturers change formulations. Database information may not reflect the most recent product version.
• Regional differences: The same brand name may have different formulations in different countries or states.

11. Third-Party Services

FoodLens integrates with third-party services. Your use of these services through the App is subject to their respective terms:

• Google ML Kit: ML Kit Terms of Service
• Google AdMob: Google Terms of Service
• Google Play Billing: Google Play Terms of Service
• Open Food Facts: Open Food Facts Terms of Use (data is available under the Open Database License)

We are not responsible for the acts or omissions of any third-party service. Any issues with third-party services should be directed to the respective third party.

12. Intellectual Property

The App, including its source code, design, graphics, user interface, and proprietary database content, is owned by MJAndroid Dev and is protected by applicable intellectual property laws.

The FoodLens name, logo, and branding are proprietary to MJAndroid Dev. You may not use them without express written permission.

Open Food Facts data is made available under the Open Database License (ODbL). We acknowledge and respect the Open Food Facts contributors.

Google ML Kit is used under Google's terms and remains the intellectual property of Google LLC.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
• THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
• IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP.
• THE DEVELOPER'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE DEVELOPER IN THE 12 MONTHS PRECEDING THE CLAIM.
• THE DEVELOPER SHALL NOT BE LIABLE FOR ANY HEALTH, MEDICAL, OR DIETARY OUTCOME ARISING FROM RELIANCE ON INFORMATION PROVIDED BY THE APP.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, the above limitations apply to the extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless MJAndroid Dev and its officers, directors, employees, and agents from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the App.

15. Termination

We reserve the right to terminate or suspend your access to the App at any time, with or without notice, for any violation of these Terms or if we reasonably believe your use is harmful to the App, other users, or third parties.

You may terminate your use of the App at any time by uninstalling it. Sections covering Disclaimer, Limitation of Liability, Indemnification, and Governing Law survive termination.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.

For disputes involving amounts under ₹10,000, the parties agree to first attempt resolution through good-faith negotiation via email before pursuing legal remedies.

17. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted at this URL with a revised "Effective Date." We will make reasonable efforts to notify you of significant changes via an in-app notice.

Your continued use of the App after updated Terms are posted constitutes your acceptance of the changes. If you disagree with the updated Terms, you must stop using the App.
